Legal Heir Certificate Questions NRIs Ask

What is a legal heir certificate in India?

A legal heir/survivor certificate identifies lawful heirs of a deceased person for claims, pensions, and some transfers. It differs from a succession certificate or probate, which courts issue for broader asset administration.

Commonly for bank account closure, insurance, employer benefits, or municipal records when the estate is small and non-court routes apply. Requirements vary by bank and state.

Yes. Our liaisons file with tehsildar/revenue authorities or local bodies, submitting affidavits, death certificate, and heir proofs. You provide notarised documents from abroad.

Legal heir certificates are administrative. Succession certificates are court orders for debts/securities. We advise which document your bank or authority requires.

Typically 2–6 weeks depending on state and document completeness. Complex heir disputes take longer.

Death certificate, family tree affidavit, heir ID proofs, address proof, and sometimes newspaper publication. We provide a state-specific list.

Often banks and buyers also require mutation, NOCs, or succession/probate orders. We map the full transfer path before you list property.
